End user licence agreement (EULA)

Subject to this EULA and your compliance with it, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices that you own or control, solely for your own lawful purposes in accordance with the documentation we provide.

You must not, and must not permit others to:

• Copy, modify, adapt, translate, or create derivative works from the App except as allowed by applicable law;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the limited extent such restrictions are prohibited by law;
• Rent, lease, lend, sell, sublicense, or otherwise redistribute the App;
• Remove, obscure, or alter any proprietary notices on the App;
• Use the App in any way that violates law, third-party rights, or our Terms of service.

The App and all associated content (excluding your user data) are owned by BPS Dynamic or its licensors and are protected by copyright, trade mark, and other intellectual property laws. No rights are granted except the limited licence above.

The App may rely on third-party services (such as cloud hosting or identity providers). Your use of those services is subject to their terms and our Privacy policy.

If you obtain the App through Apple App Store or Google Play, you acknowledge that this EULA is between you and BPS Dynamic only, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content. Apple and Google have no obligation to provide maintenance or support for the App. To the maximum extent permitted by applicable law, Apple and Google will have no warranty obligation whatsoever with respect to the App. Apple and Google are third-party beneficiaries of this EULA solely in respect of your licence of the App from their respective stores, where required by their terms.

To the maximum extent permitted by law, the App is provided “as is” without warranties of any kind, express or implied. Nothing in this EULA excludes or limits liability that cannot be excluded or limited under South African law.

We may suspend or terminate your licence if you breach this EULA or the Terms. You may stop using the App at any time and delete your account as described in our Account & data deletion notice. Upon termination, your licence ends and you must cease use of the App and delete all copies in your possession.

This EULA is governed by the laws of the Republic of South Africa. You submit to the non-exclusive jurisdiction of its courts, without prejudice to mandatory consumer protections that apply where you live.
